Welcome to Empyrean Roots. These terms apply whenever you use empyreanroots.shop (the “Site”), whether you’re reading, browsing, subscribing, or buying. By using the Site, you agree to them. If you don’t agree, please don’t use the Site.
Empyrean Roots is operated by [Empyrean Roots LLC] (“Empyrean Roots,” “ER,” “we,” “us”).
1. What we are
Empyrean Roots is an editorial platform and curated marketplace for designers and makers from the broader diaspora. Some pieces featured here are sold by us. Others are sold directly by the makers or through outside retailers. Each product listing says who the seller is.
2. Your account
Some parts of the Site, including Resources, are only open to registered customers. Keep your login details private. You’re responsible for what happens under your account. Tell us at [email] if you think someone else has used it. We may suspend or close accounts that break these terms.
3. Orders and payment
Every order is subject to availability and acceptance. Many pieces are handmade or made in small batches, so each one may differ a little in color, texture, or finish from its photos. We’ll correct pricing or listing errors when we find them, and we may cancel an affected order and refund you in full. Payment is taken at checkout through our payment processors. We don’t store your full card details.
4. Shipping, returns, and made-to-order pieces
Shipping times, return windows, and exclusions are covered in our Shipping & Returns Policy, which is part of these terms. Custom, made-to-order, and final-sale pieces can’t be returned unless they arrive damaged or defective.
5. Makers and outside sellers
Most products on the Site are sold by independent makers or outside retailers, including through affiliate links. When you buy from them, you’re buying from them directly, and their terms, policies, and customer service apply. We choose who we feature carefully, but we aren’t responsible for their products, orders, or fulfillment.
6. Affiliate links
Some links on the Site, including in The Bookcase, are affiliate links. If you buy through one, we may earn a small commission at no extra cost to you. Affiliate relationships never decide what we feature.
7. Email subscriptions
If you sign up for the Mailing List, Newsletter, or Notes, you’ll get the emails you chose. You can change your preferences in My Account or unsubscribe at any time from the link at the bottom of any email.
8. Our content and your license to use it
Everything on the Site (including NOTES, On Craft & Culture, Resources, The Bookcase, and our design dictionary and glossary) is made up of: (i) materials relating to Empyrean Roots and its products, services, and editorial work, along with similar materials from the makers, designers, retailers, licensors, and other third parties we feature, including all layout, text, articles, posts, product descriptions, dictionary and glossary entries, illustrations, photographs, images, videos, graphics, designs, data, files, scripts, software, interactive features, the look and feel of the Site, and the selection, compilation, and arrangement of all of it; (ii) trademarks, logos, trade names, trade dress, and service marks of various parties, including Empyrean Roots and the makers and brands we feature; and (iii) other forms of intellectual property (together, the “Content”). All right, title, and interest in the Site and the Content belongs to Empyrean Roots or to the makers, designers, licensors, and other third parties who own it, and is protected by U.S. and international copyright, trademark, trade dress, patent, and other intellectual property and unfair competition laws to the fullest extent possible.
The pieces we feature, and their photos, belong to the makers, designers, and brands who created them. Featuring a piece here doesn’t give us, or you, any ownership of it.
We give you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Site and the Content for your own personal, non-commercial use, like browsing, shopping, and sharing links to our pages. Please don’t copy, republish, sell, scrape, data mine, use the Content to train AI or machine-learning tools, or make derivative works from it without written permission from us or from whoever owns it. Any rights we don’t expressly give you here are reserved.
9. How you use the Site
Please don’t use the Site in any way that’s unlawful or harmful, scrape or copy its content in bulk, interfere with how it works, or misrepresent who you are.
10. Disclaimers
The Site and its content are provided “as is.” Editorial content, including Resources, is for general information and isn’t professional advice. We work to keep everything accurate and available, but we can’t promise the Site will always be error-free or uninterrupted.
11. Limitation of liability
To the fullest extent the law allows, Empyrean Roots is not liable for indirect, incidental, or consequential damages that come from your use of the Site. Our total liability for any claim is limited to the amount you paid us for the order the claim concerns.
12. Changes
We may update these terms from time to time. The date at the top shows the latest version. If you keep using the Site after a change, you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Massachusetts, without regard to its conflict-of-law rules.
